These are the Terms and Conditions of the SleepMaker Bali and BACK Trade Promotion, a promotion conducted by SleepMaker Australia, a division of the Australian Comfort Group Pty Ltd, ABN 23 098 742 584, of 447 Foleys Road, Deer Park, Victoria 3023 (Promoter).
Information on how to earn entries into the major prize draw form part of these Terms and Conditions. Entry into the promotion is deemed acceptance of these Terms and Conditions.
The promotion starts at 12:01am (AEST) on 20/06/2016 and ends at 11:59pm (AEST) on 31/07/2016 (Promotional Period).
The Winners of the 3 Major Prize draws will each be rewarded with a trip for two (2) adults to Bali staying at the Pavilions Bali, Sanur. Prize pool value $ $4982.00 for 2 people.

Travel must be 29April- 23 June / 08th July-16sep / 01 October-16 Dec /06January - 31st March 2107. Package is subject to availability at the time of booking. Air tickets which remain unused after the expiry date of the agreement shall be deemed null and void. Bookings cannot be changed once made.
The winner(s) and their companion are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers, laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. The winner is also responsible for all applicable government and security taxes and levies, insurance surcharges and airport charges. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
Participation is only open to natural persons who: (i) are residents of Australia aged 18 years or older; However SleepMaker directors, management and employees (and their immediate families) of the Promoter, its related entities, consultants, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion are ineligible to participate in this promotion.
To participate in the promotion, Participants must purchase a Miracoil Mattress during the Promotional Period, and register by logging onto www.sleepmaker.com.au/bailandback (Promotional Website) and fully and correctly complete and successfully submit the online registration form in the manner required.
Only one (1) registration per person permitted. Any subsequent registration after the first valid registration is received will be deemed invalid. The decision by the Promoter to accept or reject any sales made by any Participant is in the Promoter’s sole discretion and no correspondence will be entered into.
Participants are only able to earn entries once for each eligible purchase. Multiple Participants cannot earn entries for the same eligible purchase. If an Eligible purchase is cancelled or the product(s) sold are returned during the Promotional Period, the Eligible purchase will be deemed invalid and no entry will be earned for the original entry.
In order to receive an entry into the Major Prize Draw, Participants must, by 11:59pm (AEST) on 31/07/2016, register SleepMaker Miracoil Mattress purchase by logging onto the Promotional Website and fully and correctly complete and successfully submit the online claim form in the manner required (including providing details of each Eligible purchase made during the Promotional Period). The SleepMaker Miracoil Mattress purchase registered will receive one (1) entry into the Major Prize Draw.
Each valid entrant who has entered the competition over the duration of the promotional period will be entered into the draw. One (1) valid entrant will be drawn at random to become the winners. The draw will take place at SleepMaker Australia, a division of the Australian Comfort Group Pty, 447 Foleys Road, Deer Park, Victoria 3023, on Tuesday 2nd August 2016 at 11:00 (ACST) / 10:30 (AEST).
The winners (3) will be notified within 2 days of the draw. The winners will be notified of their prize in writing via email and telephone. The winners (3) will have their details published on the SleepMaker website sleepmaker.com.au on the website Thursday 4th August 2016.
The Promoter accepts no responsibility for late, lost or misdirected registrations or claims. Registrations and claims received will be considered final by the Promoter. Registrations and claims will be deemed to be accepted at the time of receipt and not the time of transmission. Incorrect, incomplete, erroneous, ineligible or incomprehensible registrations or claims will be ineligible. Contact details entered incorrectly on the Promotional Website by a Participant will deem a registration or claim invalid.
Any costs associated with accessing the Promotional Website remain the responsibility of each Participant and may vary depending on the Internet service provider used.
The use of any automated registration, claim software or any mechanical, electronic or other means that allows a Participant to automatically register, to earn entries is prohibited and will render all registrations and/or claims submitted by that Participant invalid.
Major Prize is not transferable or exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for any tax implications that may arise. Any income related taxes that may be payable as a consequence of a Participant receiving the Major Prize are the sole responsibility of the Participant. Independent financial advice should be sought.
If the Major Prize becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or reward of equal or greater value will be awarded in lieu.
Participants can only register in their own name. Participants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all claims of a Participant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid.
The Promoter reserves the right to request the Participant produce (within the requested time) appropriate documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Participant’s identity, employment, eligibility to register, earn entries into the Major Draw, each Eligible purchase made by the Participant, and any information submitted by the Participant before allowing the Participant to earn an entry into the Major Prize Draw and/or claim to claim the Major Prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or a Participant or claim has not been verified or validated to the Promoter’s satisfaction within the time requested, then any entries earned by the Participant will not be eligible to be placed in the Major Prize Draw. The Major Prize will only be awarded following any validation and verification that the Promoter requires in its sole discretion.
The Promoter reserves the right to verify the validity of any and all registrations and claims and reserves the right to disqualify any Participant for: (a) tampering with the registration and/or claim process; (b) submitting a registration and/or claim which is not in accordance with these Terms and Conditions; or (c) if the Participant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
Any attempt to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by a Participant, the Participant agrees to indemnify the Promoter for those losses, damages and costs.
If this promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or, if necessary, to provide an alternative Major Prize or reward to the same value as an original Major Prize.
To the extent permitted by law, the Promoter, and their employees and agents, shall not be liable for any claims, losses, damages, injuries, costs and expenses suffered sustained or incurred (including but not limited to indirect or consequential) as a result of, or arising out of, or in any way connected with the promotion and/or the awarding of the Major Prize.
All registrations and claims and any copyright subsisting in the registrations and claims become and remain the property of the Promoter (or its nominated agents). By participating in this promotion, Participants acknowledge and agree that their personal information will be collected by the Promoter to enable the Promoter to administer and promote this promotion (including distributing Gift Cards, if applicable) and future promotional programs via any medium including mail, telephone and commercial electronic messages (SMS, MMS or email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. If the personal information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible. Retail customer information provided by Participants on register print outs or sales receipts will not be used for future marketing purposes. The Promoter may share information with its Australian related companies and promotional partners who may contact Participants with special offers in this way. All personal information will be stored at the office of the Promoter. Participants may contact the Promoter at the address provided in Condition 1 to request access to any of their personal information. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
