1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Promoter 2. The Promoter is Madman Entertainment, Building 1, Level 1, 21-31 Goodwood St, Richmond VIC 3121 (“Promoter”). Promotional Period 3. Promotion commences on 15/5/14 and ends at midnight AEST on 23/6/14. (“Promotional Period”). Eligibility to Enter 1. Entry is only open to Australian residents aged 18 years or over. 2. Employees (and their immediate families) of Madman Entertainmentand Peregrine Adventures Pty. Ltd. (ABN 54 006 831 974) of Level 4, 380 Lonsdale Street, Melbourne, Victoria 3000 ‘Peregrine” and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 3. By entering this competition and ticking the opt in box the entrant agrees to receive marketing and promotional material from Peregrine Adventures. How to Enter 1. To enter, individuals must during the Promotional Period go to www.thetriptoitaly.com.au and fill in the online entry form with their details. All indiciated fields must be completed, or else your entry will be invalid. 2. In 25 words or less tell us the thing you most want to do in Italy. 3. The online entry form must be submitted by 5pm AEST on 23/6/2014. 4. Only one (1) entry permitted per person. Each entry must be submitted in accordance with the entry requirements. 5. Madman Entertainment and Peregrine Adventures reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at Madman Entertainment and Peregrine Adventures discretion. Failure by Madman Entertainment or Peregrine Adventures to enforce any of its rights at any stage does not constitute a waiver of those rights. 6. Incomplete or indecipherable entries will be deemed invalid. Draw and Prize 1. The winner will be the person who provides the most original and inventive answers to the question, as determined by the Judges on 24/6/2014 in their absolute discretion. 2. This is a game of skill, and chance plays no part in determining the winners. 3. The Judges' decision is final and no correspondence will be entered into. 4. The winner will win two (2) places (for two (2) adults) on the Peregrine Adventures tour Magical Tuscany & the Portofino Peninsula. They will also win two (2) flights from Australia (nearest capital city) to Florence, Italy. The prize can only be used on a new booking. 5. The tour must have 4 passengers already confirmed on it and needs to be taken between 1 October 2014 and 31 August 2015. Tours are subject to booking availability. 6. The winner must book through Peregrine Adventures Travel Centre in Melbourne at least 56 days before the tour departs. 7. Extra costs outside those detailed on the tour itinerary are the responsibility of the winner. These include but are not exclusive to: pre- and post-tour accommodation, spending money, additional meals, travel insurance, transfers, items of a personal nature, in-room charges, visas, passports, taxes and all other ancillary costs that are not listed in the prize tour itinerary. 8. The winner is responsible for ensuring that they have a valid passport, and any requisite visas, vaccinations and travel documentation. Itinerary to be determined by Peregrine Adventures in their absolute discretion. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in. 9. Only one (1) prize draw will be conducted for this promotion and only one (1) prize will be awarded. 10. The winner will be notified by Madman Entertainment in writing by email by 2/6/2014. 11. Subject to the terms and conditions of the participating prize provider(s), if for any reason the winner does not, once the prize has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash. No compensation will be offered if the trip is not taken. 12. The Promoter and Peregrine Adventures accepts no responsibility for changes in prize value, tour itinerary or inclusions between now and the ultimate travelling date. Compensation will NOT be offered for any changes. The prize and booking of the prize is subject to the standard Peregrine Adventures booking terms and conditions which will be provided to the winner. General 1. If there is a dispute as to the identity of an entrant, Peregrine Adventures reserves the right, in their sole discretion, to determine the identity of the entrant. 2. Peregrine Adventures decision is final and no correspondence will be entered into. 3. In the event of war, terrorism, state of emergency or disaster, Peregrine reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority. 4. Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize (or part of the prize) by the time stipulated by Peregrine Adventures, then the prize (or that part of the prize) will be forfeited. 5. If the prize (or part of the prize) is unavailable, Peregrine Adventures, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. 6. Total prize value is up to AU$11,810. (Tour cost $7370 and approx flight cost $4440 – based on flights in Jan 2015 with KLM and Alitalia $2220 as seen on 14 April 2014). 7. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash. 8. Entrants consent to Madman Entertainment and Peregrine Adventures using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by Madman Entertainment or Peregrine. 9. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Madman Entertainment or Peregrine Adventures, including but not limited to technical difficulties, unauthorised intervention or fraud, Madman Entertainment and Peregrine Adventures reserve the right, in their sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 10. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 11. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Madman Entertainment and Peregrine Adventures (including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 12. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Madman Entertainment and Peregrine Adventures (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under Madman Entertainment or Peregrine Adventure’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Peregrine Adventures) due to any reason beyond the reasonable control of Madman Entertainment and Peregrine Adventures; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of the prize and/or participation in the prize. 13. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter, and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 14. Madman Entertainment and Peregrine Adventures collect personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. 15. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to Madman Entertainment and Peregrine Adventures. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
